ChewView is not a babysitter, a child safety device, or a substitute for adult supervision. Adult supervision is required at all times when a child is eating, regardless of whether the app is in use.
Eating poses choking and aspiration risks. These risks are inherent to the act of eating and are not introduced, increased, or mitigated by software. A child can choke silently and without warning. No camera-based application, including ChewView, can detect, prevent, or respond to a choking event.
By using ChewView, you confirm that you remain in the same room as the child, within arm's reach, paying attention, and able to respond to a medical emergency. You alone are responsible for your child's safety. See Sections 3 and 14 below.
1Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and Esprizzle Inc. ("Esprizzle", "we", "us", "our") concerning your use of the ChewView mobile application for iPhone and iPad and the chewview.esprizzle.com website (together, the "Service"). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.
If you are using the Service on behalf of a child, you represent that you are the child's parent or legal guardian and that you are accepting these Terms on your own behalf and as the responsible adult for the child.
2About ChewView
ChewView is a consumer iOS app intended to be used by a parent or guardian during a child's mealtime. The app uses on-device camera processing to detect chewing motion in real time. When chewing stops, the app pauses a playing video; when chewing resumes, the app resumes the video. The intent is to encourage the child to keep eating without parental nagging.
ChewView is a video-playback and motion-detection convenience. It is not a medical device, not a feeding therapy product, not a behavioral-modification clinical tool, and not a child-safety monitoring system. ChewView makes no medical claims, no health claims, no nutritional claims, and no developmental claims.
3Parental responsibility and child safety
This is the most important section of these Terms. Read it carefully.
Adult supervision required
You agree that an adult (you or another responsible adult of legal age in your jurisdiction) will be physically present in the same room as the child for the entire duration of any meal during which ChewView is used. You will remain within arm's reach of the child. You will not use ChewView as a reason to leave the room, look at another screen, or otherwise reduce the attention you would normally give the child while they eat.
ChewView does not detect choking
ChewView's camera-based detection identifies jaw movement consistent with chewing. It cannot, and does not attempt to:
- Detect a choking event.
- Detect aspiration of food or liquid.
- Detect a child in respiratory distress.
- Detect an allergic reaction or anaphylaxis.
- Detect any medical event of any kind.
Choking can be silent. A choking child may not cough, gag, or make any sound. ChewView's pause behavior is triggered only by a lack of chewing motion within a parent-set time window (default: 5 seconds). A paused video does not indicate any medical situation. A playing video does not indicate the child is safe.
Food preparation, posture, and supervision are your responsibility
You are solely responsible for:
- Choosing food that is appropriate for your child's age, developmental stage, dental development, and any medical condition (including but not limited to allergies, sensory issues, swallowing disorders, and reflux).
- Preparing food in sizes and textures appropriate for safe chewing and swallowing.
- Seating your child in a stable, upright eating position with adequate head and trunk control.
- Avoiding running, walking, lying down, or playing during eating.
- Recognizing the signs of choking and responding immediately using techniques appropriate for your child's age.
- Maintaining current first-aid and pediatric CPR/choking response skills sufficient for your child.
Common choking hazards
Foods commonly cited as choking hazards for young children include (but are not limited to) whole grapes, hot dogs in coin-shape pieces, hard candy, popcorn, nuts, chunks of peanut butter, raw vegetables in large pieces, marshmallows, gum, and large chunks of meat or cheese. Pediatric authorities recommend cutting grapes lengthwise into quarters, slicing hot dogs lengthwise, avoiding whole nuts for young children, and serving food in age-appropriate pieces. You are responsible for following current pediatric guidance from your own pediatrician and from authoritative sources such as the American Academy of Pediatrics. ChewView does not provide and is not a substitute for medical or nutritional advice.
You are the gate
ChewView shows your child the videos that you, the parent, have explicitly approved. ChewView does not auto-add, auto-suggest, or auto-recommend videos to be shown to your child. You are responsible for reviewing each video before approving it.
4Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and capable of forming a binding contract to accept these Terms. You must be the parent or legal guardian of any child who interacts with the Service. The Service is not intended for direct use by children; children use the Service only under your direct supervision and on your authority.
5Apple App Store and your Apple ID
ChewView is distributed exclusively through Apple's App Store. Your download and use of the app from the App Store is also subject to the Apple Media Services Terms and Conditions and the Apple End User License Agreement, available at apple.com/legal/internet-services/itunes/. The Apple App Store EULA applies to your download. Where these Terms conflict with the Apple App Store EULA, the Apple App Store EULA prevails for App Store distribution matters.
6License
Subject to your compliance with these Terms, Esprizzle grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use ChewView on iOS devices that you own or control, for personal, non-commercial purposes within your household.
You may not: (a) modify, reverse engineer, decompile, or disassemble the app except where this is required by applicable law; (b) sublicense, resell, lease, rent, or distribute the app or your access to it; (c) remove or alter copyright, trademark, or proprietary notices; (d) use the app or its outputs as the basis for a competing service; (e) automate or script the app's behavior except for the personalization features the app itself offers.
7Pricing, free trial, and refunds
ChewView is offered with a free 7-day trial. After the trial, continued use requires a one-time $0.99 unlock processed through Apple's In-App Purchase. The price may change for new purchasers; the price you saw at the time of purchase governs your purchase. ChewView is not a subscription. We do not bill you on a recurring basis.
Refund requests are handled by Apple. Submit refund requests at reportaproblem.apple.com. Esprizzle does not process payments or refunds directly.
8YouTube content
ChewView plays YouTube videos using the standard YouTube IFrame Player. ChewView does not host YouTube content, does not require a YouTube or Google account, and never asks you to sign in to Google, you add videos to the library by pasting YouTube links. Playing a YouTube video through ChewView is subject to YouTube's own terms, including the YouTube Terms of Service and the Google Privacy Policy. YouTube content is created by third parties, not by Esprizzle. We do not endorse, control, or take responsibility for the content of YouTube videos, even when those videos are added to ChewView's library. You are responsible for previewing and approving every video before showing it to your child.
9Acceptable use
You agree to use the Service only for its intended purpose. You will not use ChewView in any way that:
- Violates any law, regulation, or third-party right (including intellectual property rights).
- Attempts to interfere with the operation of the app, our servers, or any third-party service the app interacts with (notably YouTube and Google).
- Uses any automated means to access the Service or circumvent rate limits or other access controls.
- Misrepresents your relationship to a child or attempts to use the Service to monitor or record a child who is not in your lawful care.
- Records, distributes, or publishes other people without consent.
10Your content
Any content you create within ChewView (voice prompts you record, the list of YouTube URLs you save, your child's face profile and any optional profile photo you set, your in-app settings) remains yours. Esprizzle does not claim ownership and does not retain a copy off your device. We do not have any technical means to access your content because we do not operate a server that receives it.
11Intellectual property
The ChewView app, source code, design, name, brand, logo, marketing materials, and website are owned by Esprizzle Inc. and are protected by copyright, trademark, and other intellectual property laws. The license granted in Section 6 does not transfer any ownership interest. ChewView™ and the ChewView logo are trademarks of Esprizzle Inc.
12Third-party services and content
The Service interacts with third-party services as described in our Privacy Policy. We do not control, endorse, or guarantee the availability, accuracy, or content of any third-party service. Your use of those third-party services is governed by the respective service's own terms.
13Disclaimer of warranties
Without limiting the generality of the foregoing, we do not warrant that:
- The chewing detection will be accurate, complete, or timely. False positives (the video pauses when the child is still chewing) and false negatives (the video continues when the child has stopped) are inherent to camera-based motion detection. They will occur.
- The Service will be available, error-free, or uninterrupted. iOS updates, network conditions, YouTube outages, lighting conditions, camera occlusion, and many other factors can affect the Service.
- The face identity match will be perfectly accurate. Siblings, parents, and other people may be incorrectly matched or rejected.
- YouTube videos in your library will remain available, embeddable, or appropriate at any future date. YouTube content is controlled by its uploaders and by Google.
- The Service is appropriate for any particular child, any particular meal, or any particular medical or developmental situation.
14Limitation of liability and assumption of risk
Use the Service entirely at your own risk
You expressly understand and agree that you use the Service at your sole risk. The risk of any harm to you or to any child in your care while using the Service rests with you. Esprizzle does not assume, and disclaims any obligation to assume, supervision of any child.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities (including for personal injury caused by negligence). Where the law of your jurisdiction does not allow such limitations, the limitations in these Terms apply to the maximum extent permitted by that law and not further.
Cap on monetary liability
To the maximum extent permitted by applicable law, in any case where Esprizzle's liability is not entirely excluded, the total cumulative liability of Esprizzle Inc. arising from or related to the Service, whether in contract, tort, statute, or otherwise, shall not exceed the greater of (i) the amount you actually paid to Esprizzle through Apple for your use of ChewView in the twelve months preceding the event giving rise to the claim, or (ii) ten US dollars (USD 10.00).
15Indemnification
You agree to indemnify, defend, and hold harmless Esprizzle Inc., its officers, directors, employees, affiliates, agents, suppliers, and licensors, from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any law or any right of any third party (including YouTube/Google's terms); (d) any harm, including any physical injury or death, to any child in your care during or in connection with use of the Service. This obligation survives termination of these Terms.
16Termination
You may stop using the Service at any time by deleting the app from your device. We may suspend or terminate your access to the Service if you materially breach these Terms; in particular, if you misuse the Service in a way that creates a risk of harm to a child or to others, or if you violate third-party rights, we may take immediate action.
Sections that by their nature should survive termination will survive, including without limitation Sections 3 (parental responsibility), 11 (intellectual property), 13 (disclaimer of warranties), 14 (limitation of liability), 15 (indemnification), 18 (governing law), and 19 (dispute resolution).
17Changes to the Service and to these Terms
We continuously improve ChewView and may add, change, or remove features. We may also revise these Terms. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced in the app and at chewview.esprizzle.com at least 14 days before they take effect, giving you time to review. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
18Governing law
These Terms are governed by the laws of the State of Delaware, United States of America, without giving effect to its conflict-of-laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded. For consumers resident in a jurisdiction whose mandatory consumer-protection laws would apply notwithstanding this provision, those mandatory laws apply to the extent required.
19Dispute resolution
You and Esprizzle agree to first attempt to resolve any dispute informally by sending a written notice to contact@esprizzle.com describing the dispute and the requested resolution. We will respond within thirty (30) days. If the dispute is not resolved within sixty (60) days of the notice, either party may pursue formal remedies. The state and federal courts located in Delaware shall have exclusive jurisdiction over any dispute arising out of these Terms or your use of the Service, except where a consumer's mandatory home-jurisdiction laws provide otherwise.
20Miscellaneous
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision is reformed only to the extent necessary to make it enforceable.
No waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later.
Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.
Entire agreement
These Terms (together with the Privacy Policy and any third-party terms referenced here) constitute the entire agreement between you and Esprizzle concerning the Service and supersede any prior agreements or representations.
